Police responded to a call shortly before 4 a.m. about a possible apartment burglary at 3850 Garden View Drive in Grand Forks. According to court documents, officers found a broken window through which witnesses said the suspect, Dustin Dalbey, 21, had entered an apartment.

When officers got to the apartment, Dalbey fled out a window and led officers on a foot chase, court documents said.

After officers caught Dalbey, they reported recovering several items, which Dalbey admitted had come from the apartment: two iPods, a BlackBerry smartphone, three pairs of women's underwear and garter belts and pictures of the women who rent the apartment.

Officers also reported finding a knife at the scene.

At his first appearance in Grand Forks County District Court on Wednesday, Dalbey was represented by attorney Blake Hankey. Hankey told the court the two men are first cousins.

Hankey also said Dalbey is friends with the women who live in the apartment and was with them "throughout the night" before the alleged incident.

Dalbey is being charged with two felony offenses, burglary and property theft. He also faces misdemeanor charges for fleeing police and for allegedly breaking the window.

Dalbey's bail was set at $5,000 on Wednesday. A preliminary hearing is scheduled for July 25.
