A Perham man was sentenced in Otter Tail County District Court last Monday for fifth degree drug possession after calling a pharmacy and trying to obtain the prescription drugs of a person who had died a month earlier.
Brandon Richard Libby, age 30, will serve his time in the county jail, with 50 days of credit for time already served. He will be on supervised probation for 10 years, monitored by the Minnesota Department of Corrections.
According to court records, on Feb. 25, Libby attempted to procure, possess or have control over a controlled substance by fraud or deceit.
A pharmacy contacted authorities to report a call on an automated prescription line belonging to an individual who had died the previous month. Later, the pharmacy was called by someone using a false name, who asked if the prescription was ready.
The pharmacy and authorities worked in conjunction to apprehend Libby.
Court records show Libby has a previous controlled substance conviction.
