Christopher Stephen McIlvain, 35, of Dent, was sentenced in Otter Tail County District Court on July 24 following a gross misdemeanor conviction of operating a vehicle with negligence while under the influence of alcohol.
His conviction follows an incident that took place June 20 at the intersection of Highway 35 and 360th Street, near Dead Lake, southwest of Dent. Just before 6 p.m., McIlvain struck the driver of another vehicle. Charges pertain to leaving the scene of an accident and refusing to submit to a chemical test were dismissed in a plea agreement.
McIlvain will serve 40 days in the county jail. A total of 325 days of confinement was stayed for six years. He also will take part in a chemical assessment coordinated by Otter Tail County Human Services.
